Terms and conditions of sale and website use

These general terms and conditions (“General Conditions”) define the terms and conditions of use for business-to-consumer and business-to-business services offered by Agricola Piano s.r.l., with registered office in Apricena (FG), Italy, Via Stefano Canzio 18 (“the Company” or “we”), accessible via the website www.agricolapiano.com (“the Website”).

We invite users to carefully read these General Conditions before browsing and in any case before registering or using the Services. These Conditions include all notices, legal disclaimers, information, or warnings published on the Website and the terms referred to via links on this page.

Access to, navigation, and use of the Website constitute express acceptance of the terms set out herein. Use of all services offered by the Company requires registration on the Website and full acceptance of these General Conditions. If you do not accept them, please refrain from using the Website and its services.

  1. DEFINITIONS

    1. “Buyer”: any natural or legal person registered on the website;
      b. “Agricola Piano Services”: services offered through the website www.agricolapiano.com;
      c. “Users”: persons accessing the Website;
      d. “Registered Users”: Users who have completed the registration process.

  2. CHANGES TO THE GENERAL CONDITIONS

    The Company reserves the right to modify or update these General Conditions and the Services offered. Changes will be communicated by publishing on the Website. Continued use of the Website by the User constitutes acceptance of such changes. Users may request account deletion by writing to info@agricolapiano.com with the subject line “Account Deletion”.

  3. REGISTRATION

    3.1 ACCOUNT
    To use the Services, you must create a personal Account with accurate and updated information. The Account is personal and non-transferable.

3.2 CREDENTIALS
The User is responsible for keeping their login credentials confidential. In case of a breach, the User must promptly notify the Company at info@agricolapiano.com. Account suspension requires at least 1 business day.

3.3 MINORS
Registration is allowed only for adults. Minors may only use the services with the assistance of a parent or guardian.

  1. USER CONTENT

    Users may post reviews and content, which must not include illegal, defamatory, or offensive elements. The User declares they hold the necessary rights to the published content. The Company reserves the right to remove inappropriate content.

  2. WEBSITE USE

    The User agrees not to:
    • violate applicable laws;
    • spread viruses or cause technological damage;
    • interfere with the proper functioning of the Website;
    • duplicate accounts or use false identities;
    • copy content without authorization.

In case of violation, the Company reserves the right to delete the account.

  1. INTELLECTUAL PROPERTY

    6.1 All Website content is owned by the Company and protected by applicable laws.
    6.2 Trademarks and distinctive signs may not be used without authorization.

  2. SERVICE INTERRUPTION

    The Company does not guarantee uninterrupted or error-free access. Interruptions may occur for maintenance or updates and will be communicated on the Website when possible.

  3. LIMITATION OF LIABILITY

    The Company is not liable for:
    • content on third-party linked sites;
    • damages from viruses or service interruption;
    • indirect or consequential losses;
    • disruptions caused by logistics partners.

Claims for compensation shall not exceed the purchase price of the product concerned.

  1. INDEMNITY

    The User indemnifies the Company from any liability arising from violations of these Conditions or from published content.

  2. PRIVACY

    Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), as described in our Privacy Policy available on the Website.

  3. ACCOUNT DURATION AND DELETION

    These Conditions remain valid as long as the User maintains their Account. The Company may suspend or delete an account in the event of violations, after notifying the User. Reinstatement is possible within 15 days if the User remedies the violations.

  4. COMPLAINTS

    The Buyer may report defects within 8 days of delivery by writing to info@agricolapiano.com. In case of defect, they are entitled to replacement, price reduction, or refund.

  5. RIGHT OF WITHDRAWAL

    13.1 Exclusions
    The right of withdrawal does not apply to:
    • Goods purchased by professionals or with invoice;
    • Perishable or opened products;
    • Sealed goods that have been opened after delivery.

13.2 Exercising the right of withdrawal
Withdrawal must be exercised within 14 days by sending an email to info@agricolapiano.com with subject “Exercising right of withdrawal”, specifying order details. Return shipping is at the customer's expense, unless the product is defective. Refund will be made within 14 days of receipt of the returned goods.

  1. ELECTRONIC COMMUNICATIONS

    Communications between the Company and Users will be electronic, via email or notices on the Website, and will be considered valid under the law.

  2. FINAL PROVISIONS

    Failure to enforce a clause does not constitute a waiver. If a clause is deemed invalid, the remaining provisions remain effective.

  4. APPLICABLE LAW AND JURISDICTION

    These Conditions are governed by Italian law. The competent court for disputes is Foggia.

In accordance with Articles 1341 and 1342 of the Italian Civil Code, the User expressly approves the following articles: 2, 3.2, 4, 5, 6, 8, 9, 11, 13, 15, and 17.
