Definitions Of Terms

Unless otherwise and expressly provided for in other specific provisions the terms listed below have in the present purchase conditions, the meaning attributed to them in the following definitions:

  • For WORKING DAYS we mean the days when our offices are open for normal activities (generally every day from 9am to 6pm except Saturdays, Sundays, public holidays and on the occasion of some exceptional circumstances of which we will give you timely news on this site).
  • They are considered CAUSE OF FORCE MAJEURE, the situations resulting (directly or indirectly) from possible strikes, lockouts, fires, floods, proven inability to procure products, materials or services, breakdowns, delays by suppliers or couriers, laws or government regulations or any other cause or event that is beyond our control. The above is provided as an example only. There are other events that can have force majeure.

In any case, the customer will be promptly informed by e-mail or telephone notification.

Object

The present purchase conditions are for the purchase of food products carried out remotely via an electronic network on the site “eng.agricolapiano.com” belonging to Agricola Piano S.r.l.s. based in Via S. Canzio, 18 71011 Apricena – Foggia. These purchases are reserved to Business to consumer (B2C). Each purchase transaction will be governed by the provisions of Legislative Decree 185/99 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Legislative Decree n. 196/03.

Acceptance Of The Order

By sending the order online, the Customer transmits to the Agricola Piano S.r.l.s. a proposal to purchase the product and / or products included in the cart. When the Customer places an order online for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these purchase conditions. Agricola Piano S.r.l.s. will send the Customer an e-mail of acceptance and confirmation of the order containing the number, date and total amount of the order and the methods of delivery of the product. If, for any reason, Agricola Piano S.r.l.s., was not able to process the Customer’s order (for one of the cases indicated below), he will immediately communicate it to the Customer via the website or by telephone.

In particular Agricola Piano S.r.l.s. will cancel the order:

  • In case of purchase of a product in the Agricola Piano S.r.l.s. but in quantities less than the order placed by the customer, this is a product no longer in production;
  • If the credit card issuer of the customer does not confirm the payment.

Agricola Piano S.r.l.s. however, reserves the right not to accept the order, even in this case communicating it to the customer.

Customer Commitment

These general conditions of purchase must be examined online by customers before sending their orders. The submission of the order therefore implies their total knowledge and their full acceptance.

The Customer agrees and obliges, once the online purchase procedure is concluded, to print and keep these general sales conditions, already viewed and accepted during the purchase process, in order to fully satisfy the condition of to the articles 3 and 4 of Legislative Decree no. 185/1999.

Prices
All prices on this site include VAT.
The prices shown on this site are the sales prices currently in force.

Payments
The payment of the purchased products and the relative shipping costs must be made by the customer at the time of placing the order, using one of the credit cards available and indicated on-line, via PayPal, by bank transfer (in this case the order will be processed upon receipt of the CRO number or at the time the bank is credited with the sum).

Deliveries

In case of acceptance of the order it is specified that:

  • Shipments will be made within 15 days from the order, except for cases in which it is specified that the ordered goods are not in stock, then waiting for arrival at our warehouse;
  • If the order was placed on a non-working day, the order will in any case be examined on the first following Business Day.

Exceptions may occur in the event of FORCE MAJEURE CAUSE.

The goods will be delivered via a home delivery service. For shipping refers to the delivery of goods to the courier. The delivery times described during the purchase process on the site depend on the shipping method used, depending on the weight and size of the items purchased. The courier will deliver the goods only against a signature confirming receipt of the same.

In the event that the goods, sent by courier, do not arrive within the established deadline, the Customer must contact Agricola Piano S.r.l.s. to the number shown on this site.

In the event that the goods have not been delivered due to the impossibility of the customer to receive it, the latter must first contact the courier through the references that are left by the courier for cases of non-receipt of the goods and, in case this operation is not possible, you can contact our warehouse through the contacts published on Agricola Piano Srls.

Responsibility For Delivery Delay

If the shipment of the goods can not take place within the agreed time or the courier in charge does not provide for delivery of the goods within the expected delivery time, Agricola Piano S.r.l.s. will contact the customer as soon as possible and, according to the latter’s needs, will try to establish another delivery term.

In the event that it is not possible to reach an agreement to this effect, Agricola Piano S.r.l.s. will reimburse the Customer for the full amount paid.

IMPORTANT: in case of return, the customer will have to apply on the external packaging of the goods to be returned, the label he receives attached to the transport documents, where he will have to write down the information received.

As the only obligation, and if the error does not depend on a fact attributable to Agricola Piano S.r.l.s., the Customer must bear the costs of returning the goods.

The goods must be returned intact and in the original packaging, complete with all its parts and without any damage.

Upon its arrival in the warehouse, the goods will be examined and, in case of damage or tampering, the refund can not be exercised

Agricola Piano S.r.l.s. will reimburse the customer the full amount already paid within the terms of the law. The refund will be made by crediting the amount due on the credit card used by the customer for the purchase subject to reimbursement, or on the bank or postal account indicated by the customer.

It will be the Customer’s responsibility to promptly provide the Agricola Piano S.r.l.s. all the necessary information for a correct and prompt repayment procedure.

Complaints

Any complaint must be addressed directly to Agricola Piano S.r.l.s., which undertakes to respond to complaints within two working days.

Jurisdiction

For any dispute the competent court is that of Foggia.
